1. Acceptance of Terms

By accessing or using the MyCustomTapCard platform ("Service"), operated by Digital Promotions, Inc., a Kentucky corporation ("we," "our," or "us"), including any features available at mycustomtapcard.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms apply to all users, including end users, print partners, and administrators.

2. Description of Service

MyCustomTapCard provides a platform that allows print partners ("Printers") to manage NFC tap card orders and allows end users ("Customers") to create digital profile pages linked to their physical NFC cards. When a physical card is tapped against a compatible device, the recipient is directed to the customer's public digital profile page containing contact information, social links, and other details chosen by the customer.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete information when creating your account.
• Maintain the security of your password and not share your login credentials with others.
• Notify us immediately if you suspect unauthorized access to your account.
• Take responsibility for all activity that occurs under your account.

4. User Content

You retain ownership of the content you upload or submit to the Service, including profile photos, card artwork, and contact information ("User Content"). By submitting User Content, you grant MyCustomTapCard a non-exclusive, royalty-free license to store, display, and transmit that content as necessary to provide the Service.

You are solely responsible for your User Content and agree that you will not submit content that:

• Infringes the intellectual property rights of any third party.
• Is unlawful, defamatory, obscene, or fraudulent.
• Contains malware, viruses, or any harmful code.
• Violates the privacy or personal rights of others.

We reserve the right to remove any User Content that violates these Terms without prior notice.

5. Public Profiles

Your digital profile page is publicly accessible to anyone with the profile link. You are responsible for the information you choose to display. Do not include sensitive personal information such as government identification numbers, financial account details, or passwords on your public profile. MyCustomTapCard is not liable for how third parties use information displayed on your public profile.

6. Print Partner Responsibilities

If you are a Print Partner using the Service, you additionally agree to:

• Review and approve customer artwork in a timely manner.
• Accurately represent your printing capabilities and services.
• Manage customer orders and communications professionally and in good faith.
• Comply with all applicable laws regarding consumer transactions and data handling in your jurisdiction.
• Keep your login credentials secure and promptly report any suspected unauthorized access.

7. Payments and Subscriptions

Certain features of the Service may require payment, including card subscriptions and one-time orders. All payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms and conditions. All sales are final unless otherwise stated. MyCustomTapCard does not store your full payment card details.

Subscription fees are billed on the applicable billing cycle (daily, monthly, or annual as selected). You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.

8. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Attempt to gain unauthorized access to any part of the Service or other users' accounts.
• Scrape, crawl, or otherwise extract data from the Service without our express written permission.
• Interfere with or disrupt the integrity or performance of the Service.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Use the Service to send spam, unsolicited messages, or engage in any form of harassment.

9. Intellectual Property

All content, features, and functionality of the MyCustomTapCard platform — including the software, design, trademarks, and branding — are the exclusive property of MyCustomTapCard and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the Service without our prior written consent.

10. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. MyCustomTapCard does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the Service is at your sole risk.

11. Limitation of Liability

To the maximum extent permitted by applicable law, MyCustomTapCard shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claims arising out of or relating to these Terms or the Service shall not exceed the amount you paid to us in the twelve months preceding the claim.

12. Account Termination

We reserve the right to suspend or terminate your account and access to the Service at our discretion, with or without notice, if we believe you have violated these Terms. You may also delete your account at any time by contacting us. Upon termination, your public profile will be deactivated and your data handled in accordance with our Privacy Policy.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a new effective date. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts located in the United States.
